Should you reserve a charter or use our Service, you consent to these Terms. Should you not consent to any part of the terms, access to the Service is not permitted.

2. Service Overview

TerraLinkCommons offers an array of high-end yacht chartering services, including but not limited to:

  • Yacht rentals for the day
  • Twilight sailing trips
  • Executive retreats
  • Exclusive events
  • Extended yacht charters

All offerings are contingent on availability and meteorological conditions. We maintain the right to adjust or cease our services without prior notice.

3. Booking and Reservations

3.1 Booking Process

To reserve a yacht, you need to:

  • Attain the minimum age requirement of 18
  • Supply both accurate and complete details
  • Render the stipulated deposit according to your reservation confirmation
  • Acknowledge and agree to these Terms & Conditions

3.2 Confirmation

Your reservation is only deemed confirmed once we acknowledge receipt of your deposit and provide confirmation in writing. We hold the right to decline service at our sole judgment.

3.3 Availability

Availability for charters is dependent on both the suitability of the vessel and favorable weather conditions. We commit to sincere efforts to meet your requested dates and timings.

4. Payment Terms

4.1 Pricing

All pricing is denoted in € and includes applicable tax unless stated otherwise. Pricing is subject to alteration without prior announcement.

4.2 Payment Schedule

  • Initial Deposit: 50% of the overall cost of the charter, due at the time of reservation
  • Remaining Balance: Must be settled 48 hours prior to the departure of the charter
  • Any ancillary fees (if applicable): To be paid upon the charter's culmination

4.3 Payment Methods

We accept payment through major credit cards, bank wires, and certified bank drafts. Payments are processed using secure, encrypted platforms.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • More than 72 hours before departure: Full reimbursement minus any service fees
  • 24-72 hours before departure: Refund of 50% of the total cost
  • Less than 24 hours before departure: No refund will be issued

5.2 Weather Cancellations

In the case of our captain declaring weather conditions as unsafe, you will be offered:

  • An opportunity to rebook for another available slot with no supplementary costs
  • A complete refund if rebooking is not feasible

5.3 Mechanical Issues

If there's a mechanical issue with the boat assigned to you, we will endeavor to arrange a comparable alternative. Should an alternative not be procurable, we will issue a full reimbursement.

6. Safety and Conduct

6.1 Safety Requirements

All clients are mandated to:

  • Heed all instructions from the crew
  • Don the mandatory safety gear when necessitated
  • Disclose any health conditions that might affect their risk
  • Stay within designated areas while on board

6.2 Prohibited Items

Items not allowed on the vessel include:

  • Containers made of glass
  • Illegal drugs
  • Firearms or any form of weapons
  • Pets (with exceptions requiring prior approval)

6.3 Conduct

Patrons must exhibit respectable behavior at all times. We reserve the prerogative to cancel a charter, without reimbursement, if the behavior of any passenger endangers safety or negatively affects the enjoyment of other individuals on board.

7. Liability and Insurance

7.1 Our Liability

We hold liability only up to the amount you've spent on your charter. We are not accountable for:

  • Injuries sustained due to a passenger’s own negligence
  • The loss or destruction of personal belongings
  • Secondary, consequential, or exemplary damages
  • Postponements caused by weather or situations beyond our management

7.2 Insurance Coverage

Our operations and vessels are protected by all-encompassing marine insurance. Responsibility for travel and personal insurance lies with the customers.

7.3 Assumption of Risk

By taking part in our yacht charters, you accept that maritime activities inherently have risks and you bear full responsibility for your personal safety and well-being.

8. Modifications and Itinerary Changes

We reserve the authority to adjust planned itineraries, paths, or timetables due to weather, safety, or operational needs. We will always strive to provide similar alternatives whenever necessary.

9. Force Majeure

We are not answerable for obstructions, annulments, or revisions brought about by issues outside of our control, including but not limited to:

  • Harsh weather conditions
  • Natural disasters
  • Governmental mandates
  • Port shutdowns
  • Technical breakdowns

10. Privacy and Data Protection

The way we handle your personal information complies with our Privacy Policy. Using our services means you permit the gathering and application of your data as outlined in the Privacy Policy.

11. Intellectual Property

The material on our site, including text, visuals, emblems, and images, is under the protection of copyright and trademark statutes. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without our expressed consent.

12. Governing Law
